Scope

These terms apply to the use of FRIZZAI! by hair salons and other commercial customers. FRIZZAI! is exclusively targeted at entrepreneurs within the meaning of § 14 BGB. Consumer contracts within the meaning of § 13 BGB are not concluded. A consumer right of withdrawal under §§ 312g, 355 BGB therefore does not apply; if a consumer should nevertheless conclude a contract, the contract is to be reversed for lack of consumer scope.

Service

FRIZZAI! provides a web-based consultation and kiosk PWA that enables salons to offer AI hairstyle previews. The currently active plans (e.g. Salon, Salon Plus, Pro), their feature scope and pricing are listed at https://frizzai.com/preise and form part of this agreement.

Contract conclusion

The contract is concluded by activating a plan through Stripe Checkout or by individual agreement. By completing Stripe Checkout the salon accepts these terms as well as the DPA.

Demo access

Public subscriptions start as paid plans directly through Stripe. A free demo access can be requested individually and activated separately.

Prices and payment

Displayed prices depend on checkout country and currency. Where the provider is a small business under Section 19 of the German VAT Act, no VAT is charged; any further VAT obligation follows from the legal notice. Billing is monthly in advance through Stripe.

Price changes

We may adjust prices with at least 30 days' notice. Adjustments are communicated to the salon by email to the address stored in the account. If the salon does not object to the adjustment within 30 days or cancel before the new prices take effect, the new prices are deemed accepted. Existing customers are granted a special right of termination effective with the price change.

Term and cancellation

Subscriptions renew monthly and can be managed or cancelled at any time through the Stripe customer portal with effect at the end of the current billing period. Cancellations are confirmed by email and become effective at the displayed date unless Stripe reports a different status. The right to extraordinary termination for good cause remains unaffected.

Customer obligations

  • The salon obtains required end-customer consents or another suitable legal basis.
  • The salon informs customers before taking photos.
  • The salon does not misuse the product.
  • The salon provides correct mandatory information.
  • The salon keeps account credentials confidential and reports any suspected misuse without delay.

Availability

We aim for an average availability of 99% per month, measured as reachability of the production consultation endpoints. Planned maintenance windows are, where possible, announced at least 24 hours in advance and excluded. Outages of third-party providers (e.g. Vercel, Supabase, Stripe, Google Gemini) and cases of force majeure are excluded from the availability commitment.

Support

Inquiries can be sent to the email address listed in the legal notice. We aim to provide a first response within two business days; for security-relevant incidents we respond without delay after becoming aware.

Liability

Liability is limited to intent and gross negligence to the extent permitted by law. For ordinary negligence we are liable only for breaches of essential contractual obligations and limited in amount to the typically foreseeable damage. Liability for personal injury, under the Product Liability Act and for fraudulently concealed defects remains unaffected.

Privacy and DPA

A DPA under Art. 28 GDPR is concluded for the processing of end-customer photos; it is deemed accepted upon contract conclusion and is available at https://frizzai.com/avv.

Changes to these terms

We may amend these terms where this is necessary to close gaps, comply with changed legal requirements or evolve the feature scope. Amendments are communicated to the salon by email at least 30 days before they take effect; without timely objection or cancellation they are deemed accepted.

Final provisions

German law applies. The place of jurisdiction is the provider's registered office where legally permissible. Should any provision of these terms be invalid, the validity of the remaining provisions remains unaffected.
